1. About these terms

kpics.com is run by KPICS, LLC, a Louisiana, United States limited liability company ("kpics", "we", "us"). By using the site you agree to these terms. When you buy a copy of a set, the Terms of your copy also apply, and our Refund policy and Privacy notice explain refunds and how we handle your information.

2. Who can use kpics.com

Anyone may browse. To create an account or buy, you must be at least 13 years old. If you are under 18, you need the consent of a parent or guardian. You may only buy for yourself.

3. Your account

  • You sign in with your email address and a one-time code or link; there are no passwords. Keep access to your email account secure, because anyone who can read your email can sign in to kpics as you.
  • One person per account. Do not share your account or let others download through it.
  • You can sign out other devices, and you can delete your account at any time from Your data. What deletion does is explained in the privacy notice.
  • Changing the email address on an account is not available on the site yet; email support@kpics.com from the address you sign in with.

4. Previews and site content

The previews, text and design of kpics.com are ours or our photographers'. Previews are shown publicly so you can decide whether to buy, but that does not give you any right to copy, download, repost or use them elsewhere. You may share links to listing pages.

Group, member and event names are used only to describe what is in each set. kpics.com is independent and is not affiliated with, or endorsed by, any artist, agency or label.

5. Buying

  • Prices are in US dollars. Prices do not include sales tax or VAT, and none is added at checkout.
  • When you start checkout, a copy is reserved for you for as long as the checkout page stays open. The copy is yours only once the payment is confirmed and the set appears in Your copies. We never deliver a set from a web page redirect alone; we wait for confirmation from the payment provider.
  • Availability figures on the site ("copies left", "temporarily reserved", "last purchased") come straight from our records at the time you look. They can change at any moment, and checkout checks availability again before you pay.
  • We may pause sales of any set, or of the whole site, for example during maintenance or a payment provider outage. Sets you already own stay downloadable during your window.
  • If a price or description on the site is clearly wrong, we may cancel the order and refund you in full before the set is delivered.

6. Acceptable use

When using kpics.com, do not:

  • use bots, scripts or automated tools to browse in bulk, reserve copies, check out or download, or try to get around rate limits or the sign-in security check;
  • try to reach files, accounts or pages you are not entitled to, or interfere with the site's security or operation;
  • share download access, links or your sign-in with anyone;
  • create accounts in someone else's name or to get around a suspension or the one-copy-per-account limit;
  • use the site to break the law or harass anyone.

7. Suspending or closing accounts

We may suspend or close an account that breaks these terms or the Terms of your copy, is used for fraud, or puts the site or other users at risk. If we close your account for a reason that is not your fault, we will refund any purchase you could not yet download. Closing an account for a breach can end your access and your right to use the photos, as the Terms of your copy explain.

8. Rights concerns and takedown requests

If you believe a photo on kpics.com infringes your rights, or shows you and you want it reviewed, email rights@kpics.com with:

  • what the concern is and which listing (a link is best);
  • your contact details;
  • if it is a copyright claim, a statement that you are the rights holder or authorized to act for them, and that you believe in good faith the use is not authorized.

We will review every request and may pause or remove a listing while we look into it. Existing buyers are handled under section 9 of the Terms of your copy.

9. The site as it is

We work to keep kpics.com available and accurate, but we provide the site as it is and cannot promise it will always be available or free of errors. This does not limit what we promise about the copies you buy (Terms of your copy, section 10) or any rights you have under consumer law that cannot be excluded.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential losses arising from use of the site, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that cannot legally be limited.

11. Changes

We may update these terms. The new version applies from its effective date, which we will show at the top. If a change materially affects you, we will tell account holders by email before it applies. Purchases already made stay under the Terms of your copy version you accepted.

12. Law

These terms are governed by the laws of the State of Louisiana, United States.
