Terms of your copy
These terms apply when you buy a copy of a photo set on kpics.com. You accept them by ticking the box at checkout. Please read them before you buy. The short version is in the box below; the full terms follow it, and the full terms are what count.
In short
- You may edit and print the photos for yourself, use them as a wallpaper on your own phone or computer, display your own prints at fan events (not for sale), and send them to one friend in a private message.
- You may not post them publicly, use them commercially, resell them, share them any further, or use them to train AI.
- Each set is a limited edition: up to the number of copies shown on its page will be sold. The photographer and kpics keep copies too, and the previews are public.
- You can download your set for 30 days after your purchase is completed. Download it and keep your own backup.
- If you have not downloaded any file of the set, you can get a refund on request within 14 days. After a download, refunds are decided case by case. A refunded copy is never sold to anyone else.
1. Who we are
kpics.com is run by KPICS, LLC, a limited liability company registered in Louisiana, United States ("kpics", "we", "us"). You can reach us at support@kpics.com. Business address: PO Box 640056, Kenner, LA 70064
"You" means the person who buys the copy with their kpics account.
2. What the words mean
- Set: the group of photos offered together on one listing page on kpics.com.
- Copy: your purchase of one set. It gives you the license in section 3 and access to download the set's files during your download window. On the site we say "copy" rather than "license"; they refer to the same purchase.
- Files: the full-size photo files of the set, delivered as one or more ZIP parts.
- Previews: the smaller images shown publicly on the listing page so you can see what is in a set.
- Edition: the maximum number of copies of a set that will ever be sold, shown on the set's page.
3. What you get
When your purchase is completed, KPICS, LLC grants you a personal license to use the files of that set as these terms allow. The license is:
- personal: for you as an individual, not for a business, group, fan account or anyone else;
- non-exclusive: other buyers of the same set get the same license;
- non-transferable: you cannot sell, give, lend or pass it on, and it does not pass with your account;
- worldwide; and
- ongoing: it does not end when your download window closes. It ends only as described in section 9.
You get a license to use the photos, not ownership of them. The photographers and KPICS, LLC keep all rights in the photos that these terms do not give you.
4. What you may do
You may, for your own personal, non-commercial enjoyment:
- Keep the files on your own devices and in your own private backups.
- Edit them: crop, retouch, color-grade, add effects or combine them with other images. Your edited versions follow these same terms.
- Print them, including through a print shop or photo lab that makes prints only for you, and display the prints in your own home or personal space.
- Use them as a wallpaper or lock screen on your own phone or computer.
- Display your own prints at fan events, as long as they are not for sale.
- Send them to one friend in a private message. This means a private message to one person. It does not include group chats, servers or channels, or cloud folders or sharing links.
5. What you may not do
Unless we agree otherwise in writing, you may not:
- Post publicly. Do not upload, post or show the files, or edits of them, anywhere others can see them: social media, websites, forums, fan sites, galleries, streams, or public or shared group chats. This includes cropped, filtered, watermarked or low-resolution versions.
- Use commercially. Do not use the files, or anything made from them, to earn money or promote anything. That includes selling prints, merchandise, photocards, stickers, fan goods or event giveaways, using them in advertising or sponsored posts, and using them in monetized content.
- Share or redistribute. Apart from sending them to one friend in a private message (section 4), do not give, send, upload or make the files available to anyone else, whether free or paid, including through file-sharing links, cloud folders, torrents or group buys ("splits").
- Resell or transfer. Do not sell or transfer your copy, your license or your account.
- Train AI. Do not use the files, or anything made from them, to train, fine-tune, test or build any artificial intelligence or machine-learning model or dataset, and do not submit them to services that do so.
- Misuse the people pictured. Do not use the files in a way that is sexualized, degrading, harassing or misleading about the people in them, including deepfakes or other synthetic alterations of a person's face or body.
- Claim them as your own. Do not claim that you took the photos or that you hold any rights in them beyond this license.
- Get around these limits, for example by sharing your account or sign-in, or by helping someone else do any of the above.
If you are not sure whether a use is allowed, ask us before you do it.
6. Limited editions
Each set is sold as a limited edition. The set's page says how many copies can be sold, for example: "Up to 7 copies of this set will be sold."
- The edition size is fixed when the set goes on sale and can never increase.
- Every copy sold counts toward the edition permanently. A copy is never sold twice: if a purchase is refunded, reversed or its access ends, that copy is not offered to anyone else, so fewer copies than the edition size may end up in buyers' hands.
- A limited edition limits how many copies kpics sells. It does not mean that only that many copies of the photos exist. The photographer and KPICS, LLC keep copies of the original files, and the previews stay publicly visible on kpics.com.
"Copies left" and "last purchased" figures on the site come directly from our order records; we do not invent urgency.
7. Downloading your files
- After your purchase is completed, the set appears in Your copies in your account. Downloads are only available there, while you are signed in. Receipt emails never contain download links.
- You can download the files for 30 days from when your purchase is completed. The exact end date is shown in Your copies and on your receipt. The length of the window is also shown on the set's page before you buy.
- You can download each part as often as you need while the window is open. Once you start a part, that download can be resumed for 24 hours.
- Please download everything you want and keep your own backup before the window ends. After it ends we do not have to keep the files available to you. If you need more time, contact us before or soon after the end date; we may extend the window, but we do not have to.
- Sets are large, often 10–35 GB. You are responsible for having the storage, connection and software to download and open ZIP files. Each part lists a checksum so you can confirm it downloaded correctly.
- If a file is damaged or incomplete on our side, see "Damaged files" in the refund policy.
8. Price and payment
- Prices are in US dollars and are shown on the set's page. Payment is taken by our payment provider, Stripe, on its secure checkout page; we never see or store your full card number.
- Prices do not include sales tax or VAT, and none is added at checkout.
- Your bank or card issuer may charge currency conversion or foreign transaction fees. Those are between you and them.
- You can buy one copy of each set per account.
- A reservation made when you start checkout lasts only while that checkout is open. A copy is yours only once your purchase is completed and appears in Your copies.
9. When the license and access end
- Refund. If we refund your purchase in full, your license and your access end, and you must delete the files and any edits or prints you still control.
- Payment disputed or reversed. If you dispute your payment through your bank or card issuer, your access continues while the dispute is open. If the payment is finally reversed, your license and access end as in item 1.
- Breaking these terms. If you break section 5, we may end your license and access without a refund, and you must delete the files and anything made from them.
- Account deletion. If you delete your kpics account, your access to downloads ends straight away. Your license continues for files you already downloaded.
- If our rights in a set change. If we stop being able to sell a set, we stop selling it. If you already bought it, you keep download access for the rest of your window, and your license continues.
Ending a license never makes a copy available to another buyer (section 6).
10. Our promises and their limits
- We promise the files will match the set's description (photo count, format, total size and editing status shown on the page) and will be free of damage that stops them opening.
- Beyond that, the files are provided as they are. Previews show the style and content of a set but are smaller and may be compressed; the full files may differ in size and quality.
- Nothing in these terms takes away rights you have under consumer law where you live that cannot be excluded by contract.
11. Our liability
To the extent the law allows, our total liability to you for anything relating to a copy is limited to the amount you paid for that copy, and we are not liable for indirect or consequential losses such as lost data, lost profits or storage costs. Nothing here limits liability that cannot legally be limited, such as liability for fraud.
12. Changes to these terms
The version of these terms you accepted at checkout is recorded with your order and continues to apply to that copy. If we change the terms, the new version applies only to purchases made after the change. We will not reduce what your existing copy allows without your agreement.
13. Governing law
These terms are governed by the laws of the State of Louisiana, United States.
14. Contact
Questions about these terms, or about whether a use is allowed: support@kpics.com. Please include your order reference if your question is about a purchase.
Damaged files and refunds
If a part is damaged, download it again. If it is still damaged, email support@kpics.com with your order reference and the part number. If the problem is on our side, we will replace the part, or refund you if we cannot.
If you have not downloaded any file of the set, you can get a refund on request within 14 days of your purchase. After a download, refunds are decided case by case. A refunded copy is never sold to anyone else. The full refund policy is on kpics.com.
